Are Court Records Public in Sevier County?

Tennessee law establishes a strong presumption of public access to court records. Tennessee Supreme Court Rule 34 affirms that the public has a statutory right to inspect records maintained by the courts, subject to specific exceptions. The Tennessee Bureau of Investigation allows the general public to request a name-based Tennessee criminal history report on any individual. Sevier County Civil Court Records

Civil litigation in Sevier County is divided between the General Sessions Court and the Circuit Court, with the Chancery Court handling certain equity and statutory matters.

General Sessions — Civil Division

Circuit Court — Civil Division

The Circuit Court handles civil cases exceeding $25,000, including personal injury, workers’ compensation, property damage, and contract disputes. The Civil Division of the Circuit Court Clerk can be reached at (865) 453-5536 ext. 3. A complete Civil Court Cost List is published on the county website. Fax filings are accepted for certain documents at a cost of $5.00 plus $1.00 per page; however, pleadings that carry a filing fee, appeals, confidential documents, and summons bonds cannot be filed by fax.

Chancery Court

The Clerk & Master’s Office handles Chancery Court filings, which encompass civil matters such as contract disputes, will contests, delinquent property tax collections, and certain custody issues. The office is open 8:30 a.m. to 4:30 p.m., Monday through Friday. Local rules governing Chancery Court practice in the Fourth Judicial District are available online. Filing fees were updated effective January 2026; a current schedule of Chancery Court fees has been posted by the Clerk & Master.

Sevier County Family Court Records

Sevier County does not have a standalone family court. Family law matters — including divorce, child custody and visitation, child support, adoption, and orders of protection — are heard primarily by the Circuit Court. The Chancery Court also exercises jurisdiction over some child support and custody matters.

Divorce Records

Divorce cases are filed and adjudicated in the Circuit Court. To obtain a copy of a divorce case file, contact the Circuit Court Clerk’s Civil Division at (865) 453-5536 ext. 3. The Clerk & Master’s Office maintains divorce decrees associated with Chancery Court proceedings and will mail certified copies upon request. The Tennessee Office of Vital Records maintains statewide divorce records, and the Tennessee State Library and Archives holds historical divorce records that are more than 50 years old.

Child Support

Court-ordered child support cases handled through the Circuit Court are managed by the Child Support division of the Circuit Court Clerk’s office, reachable at (865) 429-5270. The Chancery Court also collects and distributes child support payments. Orders of Protection

To qualify for an order of protection in Sevier County, the petitioner must demonstrate recent physical abuse or a credible threat against their life. The respondent must be a family member, household member, or someone with whom the petitioner has had an intimate relationship. Protection order cases are filed through the Circuit Court Clerk.

Marriage Records

The Sevier County Clerk’s Office issues marriage licenses and maintains marriage records. Licenses and certified copies are available at three locations:

Marriage license fees are $101.00 for Tennessee residents and $41.00 for out-of-state residents. Tennessee residents who complete a four-hour premarital course receive a $60.00 reduction. Certified copies of marriage certificates cost $5.00 in person, $15.00 by mail (money order or cashier’s check only), or $16.36 online by credit card through the online marriage certificate request portal. Applicants can also pre-apply for a marriage license online.

Birth and Death Records

The Sevier County Health Department — Vital Records office issues certified copies of Tennessee birth and death certificates. Each copy costs $15.00. Sevier County Probate Court Records

Filing Requirements

All probate filings — including petitions for probate, conservatorship, guardianship, and name changes — must be prepared by a Tennessee-licensed attorney. Probate clerks are not permitted to provide legal advice or recommend counsel.

Small Estate Affidavits

Under Tennessee Code Annotated § 30-4-101, estates valued at $50,000 or less that involve no real estate may be administered through a Small Estate Affidavit. Requirements include:

  1. Administration by an attorney
  2. A 45-day waiting period after the date of death
  3. A certified copy of the death certificate
  4. A list of all outstanding debts of the deceased
  5. If an original Last Will and Testament exists, it must be filed as an attachment

Public Access
