Are Court Records Public in Maury County?
Tennessee maintains a strong presumption of public access to government records. Under the Tennessee Public Records Act, codified at Tenn. Code Ann. § 10-7-503(a)(1)(A)(i), any citizen may inspect or copy public records held by a government entity. The Tennessee Supreme Court reinforces this principle through Rule 34, which governs public access to court records specifically.
Certain categories of records are exempt from disclosure, either by statute or court rule:
- Juvenile offender identifying information – Protected under Tenn. Code § 37-1-187.
- Grand jury proceedings – Confidential per Tennessee Rules of Criminal Procedure, Rule 6 and Rule 16.
- Hospital and medical records – Restricted under Tenn. Code § 68-11-304.
- Adoption records – Sealed upon finalization.
- Expunged records – Including those related to prostitution and human-trafficking convictions eligible for expungement.
- Vital records – Birth and death certificates carry their own statutory access restrictions.
- Jury selection lists – Confidential under Tenn. Code § 22-2-302(4)(B).
- Disciplinary counsel opinions – Not available to the public.
When a record is partially exempt, the clerk may redact the confidential portion and release the remainder. Requesters who believe a record has been improperly withheld may file a complaint with the Tennessee Office of Open Records Counsel.
