Are Court Records Public in Cocke County?

  • Written or electronic conference notes, memoranda, and internal reports prepared by a judge or judicial staff as part of the deliberative process

  • Information maintained by individual judges regarding their recusal from a particular case, unless filed as part of the case record or otherwise required to be disclosed
  • Information concerning threats to the personal safety of judges, judicial staff, or their families, and court security audits
  • Any other record whose disclosure would frustrate or interfere with the judicial function or undermine the court’s inherent constitutional powers

Additionally, certain categories of records are confidential under Tennessee statutes, including adoption records, certain juvenile proceedings, and records excepted under T.C.A. § 10-7-504. Sealed records and those covered by protective orders are also withheld from public access.

Cocke County Criminal Court Records

Criminal proceedings in Cocke County are distributed between two courts depending on the severity of the offense.

Circuit Court — Felony and Jury Cases

Marriage Records

Marriage licenses in Cocke County are issued by the Cocke County Clerk, located at 111 Court Avenue, Room 101, Newport, TN 37821, Phone: (423) 623-6176 Marriage license requirements include a valid driver’s license, picture ID, or certified birth certificate, and proof of a social security number. Both applicants must be at least 18 years of age and present in person, unless one party is incarcerated or incapacitated. Birth and Death Records

Vital records relevant to family proceedings are managed by the Cocke County Health Department, located at (423) 623-8733. Birth records are available for persons born anywhere in Tennessee (long form only). Death records are available for deaths that occurred in Cocke County over the last 100 years. The current fee is $15.00 per certificate and $15.00 for each additional copy of the same record purchased at the same time. To purchase a death certificate, requesters must be an immediate family member, a funeral home, or a legal representative, and must provide a copy of a driver’s license when the cause of death is required. Birth records are generally confidential for 100 years, and death records are restricted to authorized parties for 50 years in Tennessee. Cocke County Probate Court Records

Probate proceedings in Cocke County fall under the jurisdiction of the Chancery Court, and the Clerk & Master’s office serves as the custodian of all probate records. Adoption Records
